Terms of Service

Effective and last updated: October 2, 2026

1. Agreement to these Terms

By accessing or using ViewPort Studio, creating an account, purchasing a subscription, using the Developer API, or otherwise using our services (collectively, the “Service”), you agree to these Terms and our Privacy Policy. If you use the Service for an organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree, do not use the Service.

2. Eligibility and accounts

You must be legally capable of entering a binding contract and, in all cases, at least 18 years old to purchase a paid plan. You are responsible for accurate account information, safeguarding credentials and API keys, all activity under your account, and promptly notifying us of suspected unauthorized access. You may not sell, transfer, share, or misuse account access in a way that defeats plan limits or security controls.

3. Service and permitted use

ViewPort Studio provides responsive previews, screenshots, sharing, reports, visual audits, AI-assisted analysis, browser-extension features, and related developer tools. We grant you a limited, revocable, non-exclusive, non-transferable right to use the Service for lawful business or personal purposes in accordance with your plan.

4. Your responsibility for URLs, content, and permissions

You are solely responsible for every URL, website, image, file, brand, credential, instruction, or other material you submit or cause the Service to process (“User Content”). You represent and warrant that you have all rights and permissions necessary to access, capture, analyze, reproduce, share, and process that User Content. Do not submit confidential, regulated, highly sensitive, or third-party information unless you are authorized to do so and the Service is appropriate for that information. The Service is not designed as a repository for payment-card data, health records, government identifiers, passwords, or other highly sensitive data.

5. Acceptable use

You may not use the Service to violate law or third-party rights; access or capture systems without authorization; evade access controls, robots restrictions, rate limits, paywalls, or security measures; distribute malware; phish, scrape unlawfully, spam, harass, or surveil others; probe or attack the Service; reverse engineer except where law expressly permits; resell the Service except under a written agreement; abuse API capacity; interfere with other users; or use outputs to make unlawful or harmful decisions. We may block URLs, requests, accounts, or activity reasonably believed to create security, legal, abuse, or operational risk.

6. User Content license and public sharing

You retain ownership of your User Content. You grant us and our service providers a limited, worldwide license to host, copy, transmit, render, capture, transform, and analyze User Content only as reasonably necessary to provide, secure, support, and improve the Service and comply with law. If you create a public or shareable link, anyone with that link may be able to access the associated content. You are responsible for deciding what to share and for deleting or disabling shares you no longer want available.

7. AI and automated analysis

AI Launch Audit and other automated features may produce incomplete, inaccurate, inconsistent, or outdated results. Scores, findings, suggested fixes, and other outputs are informational tools, not guarantees of accessibility, security, performance, legal compliance, code quality, compatibility, or launch readiness. You must independently review outputs before relying on them. You retain responsibility for decisions, deployments, and changes made from any output.

8. Third-party sites and services

The Service depends on third-party hosting, authentication, payment, email, screenshot, AI, browser, and infrastructure providers and may display or process third-party websites. We do not control third-party sites, their availability, their content, or whether they permit framing or automated capture. Third-party terms may apply. A website may block previewing or capturing through security headers or other controls, and we do not promise that every URL will work.

9. Subscriptions, billing, renewals, cancellation, and strict no-refund policy

Paid subscriptions are billed in advance at the price and billing interval shown at checkout and automatically renew for successive periods until canceled, unless checkout expressly states otherwise. You authorize the payment provider to charge the payment method associated with your purchase. Taxes may apply. You may cancel to stop future renewals; unless required otherwise by law, cancellation takes effect at the end of the paid billing period.
ALL SALES ARE FINAL. ALL PAYMENTS AND SUBSCRIPTION FEES ARE NON-REFUNDABLE AND NON-CREDITABLE, INCLUDING FOR PARTIAL BILLING PERIODS, UNUSED SERVICE, FAILURE TO USE THE SERVICE, DOWNGRADES, CANCELLATIONS, ACCIDENTAL PURCHASES, OR DISSATISFACTION WITH FEATURES OR OUTPUTS. WE DO NOT PROVIDE PRORATED REFUNDS, CREDITS, OR REFUNDS FOR UNUSED TIME. CANCELLATION STOPS FUTURE RENEWALS BUT DOES NOT REVERSE OR REFUND A CHARGE ALREADY INCURRED. THE ONLY EXCEPTION IS TO THE LIMITED EXTENT A REFUND IS EXPRESSLY REQUIRED BY APPLICABLE LAW AND CANNOT LAWFULLY BE WAIVED.
Initiating a payment dispute or chargeback does not alter these Terms or create a contractual right to a refund. We may provide transaction records, acceptance records, usage records, and other relevant evidence to payment providers when responding to a dispute, subject to applicable law and our Privacy Policy. We may change prices prospectively with notice as required by law.

10. Free plans, limits, and changes

Free access, trials, quotas, plan features, APIs, device presets, storage, and usage limits may be changed, suspended, or discontinued. We may enforce reasonable technical and usage limits to protect the Service. Material changes to paid-plan commitments will be handled in accordance with applicable law and any specific written terms presented at purchase.

11. Intellectual property and feedback

The Service, software, design, branding, documentation, and underlying technology, excluding User Content and third-party materials, are owned by or licensed to the operator of ViewPort Studio and are protected by applicable intellectual-property laws. No rights are granted except those expressly stated. If you provide suggestions or feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation.

12. Suspension and termination

We may suspend, restrict, or terminate access where reasonably necessary for security, suspected fraud or abuse, legal compliance, nonpayment, material breach, or protection of users, third parties, or the Service. You may stop using the Service at any time and may request account deletion through available account controls. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, and dispute provisions—survive.

13. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL IDENTIFY EVERY RESPONSIVE, ACCESSIBILITY, SECURITY, PERFORMANCE, OR OTHER ISSUE, OR THAT THIRD-PARTY CONTENT WILL REMAIN AVAILABLE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE VIEWPORT STUDIO OPERATOR AND ITS AFFILIATES, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US$100. Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.

15. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless the ViewPort Studio operator and its affiliates, personnel, and service providers from third-party claims, damages, losses, liabilities, costs, and reasonable legal fees arising from your User Content, your use or misuse of the Service, your violation of these Terms or law, or your infringement or violation of another person’s rights.

16. Disputes and applicable law

These Terms are governed by the laws applicable to the ViewPort Studio operator, without regard to conflict-of-law principles, except where mandatory consumer law requires otherwise. Before filing a formal claim, each party agrees to make a good-faith effort to resolve the dispute informally by contacting the other party and allowing at least 30 days for a response. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using an eligible small-claims process. Mandatory rights and venues that cannot lawfully be waived remain unaffected.

17. Changes to the Service or Terms

We may update these Terms to reflect product, legal, security, or operational changes. The updated date will be posted here. Where required by law, we will provide additional notice before material changes take effect. Continued use after an update becomes effective constitutes acceptance to the extent permitted by law.

18. General terms

If any provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, reorganization, financing, or transfer of the Service. These Terms, the Privacy Policy, and any purchase-specific terms presented to you form the agreement regarding the Service and supersede prior understandings on the same subject.

19. Contact

Questions about these Terms, legal notices, or disputes may be submitted through the Support section of your ViewPort Studio account.
